DUI Manslaughter and Methamphetamine

Meth is a central nervous system stimulant and can improve a person’s ability to drive- not impair it. A study in Holland found that meth improved reaction time, alertness, and performance in life-threatening situations under certain doses depending upon the person's tolerance. Yet, in Florida, prosecutors assume impairment when a Drug Recognition Expert concludes that the person was under the influence of a central nervous system stimulant.

I had a DUI manslaughter case where meth was the only drug in the defendant's system. Yet, the accident reconstruction report showed that this defendant was heroic in his attempts to keep a pickup truck from flipping as it swerved and bucked when recovering from avoiding a sudden obstruction on the road. However, the truck flipped and killed his girlfriend. He had meth in his system. I had taken an article from Holland and the crash report to show that this defendant exercised amazing skill under the circumstances and was not impaired at all. More lawyers need to recognize this argument.
